By accessing or using any BMcks Apps application — including FitCrush, CalorieCrush, MindReset, SleepWell, or BudgetBoss — you agree to be bound by these Terms of Use. If you do not agree, please do not use these apps.

These terms apply to all users of all apps available at bmcksapps.com and hosted on bmcksos.polsia.app.

These Terms of Use govern your use of the following applications:

FitCrush — This app is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before starting any exercise program. BMcks Apps is not responsible for any injuries that may occur. If you experience pain, dizziness, or discomfort, stop exercising immediately and seek medical attention.

CalorieCrush — This app provides general nutritional information for educational purposes only. It is not a substitute for professional dietary or medical advice. Calorie counts and nutritional data are estimates. Consult a registered dietitian or healthcare provider before making significant changes to your diet, especially if you have medical conditions.

MindReset — This app provides breathing exercises and journaling tools for general wellness purposes only. It is not a substitute for professional mental health treatment. If you are experiencing a mental health crisis, please contact a mental health professional or call 988 (Suicide & Crisis Lifeline).

SleepWell — This app provides general sleep tracking and wellness information. It is not a medical device and should not be used to diagnose or treat sleep disorders. If you experience persistent sleep problems, consult a healthcare provider.

BudgetBoss — This app provides general expense tracking tools for personal use only. It does not constitute financial advice, investment advice, or tax advice. Caloric, budget, and financial data are estimates and may not be accurate. Consult a qualified financial advisor or accountant for financial planning decisions. BMcks Apps is not responsible for financial decisions made based on data from this app.

All BMcks Apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, completeness, or reliability of content or data
• Fitness for a particular purpose
• Uninterrupted or error-free availability
• Security or freedom from viruses or malicious code

Use of these apps is at your own risk.

To the fullest extent permitted by applicable law, BMcks Apps and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — any application, including but not limited to:

• Physical injury from exercise programs or health changes
• Financial loss from decisions informed by the apps
• Data loss or corruption
• Reliance on AI-generated advice or recommendations

BMcks Apps are designed to be device-based — most data is stored locally on your device using localStorage or similar browser storage. No personal account registration is required.

• Some features (AI coaching, journal history) may transmit data to our servers or third-party AI providers (OpenAI)
• We do not intentionally collect or sell personal information
• Third-party services (Google AdSense, Meta Pixel) may collect analytics data as described in their respective privacy policies
• Clearing your browser data will remove locally stored app data

Several apps use AI (powered by OpenAI) to generate coaching, insights, meal plans, and recommendations. This AI-generated content:

• Is generated automatically and not reviewed by qualified professionals
• Should not be relied upon as professional medical, nutritional, financial, or mental health advice
• May contain inaccuracies or errors
• Is provided for informational and entertainment purposes only

You agree to use BMcks Apps only for lawful purposes. You may not:

• Attempt to reverse engineer, decompile, or extract source code from the apps
• Use automated means to scrape or access the apps at scale
• Attempt to disrupt or interfere with the apps' servers or networks
• Use the apps in any way that violates applicable local, national, or international laws

Some features require the purchase of credits, a Pro subscription, or a Lifetime access plan. All purchases are processed securely via Stripe.

• All sales are final — we do not offer refunds except where required by law
• Subscription plans renew automatically; cancel anytime before the renewal date
• Credits are non-transferable and have no cash value
• Prices are subject to change with reasonable notice

We may update these Terms of Use from time to time. Continued use of any BMcks App after changes are posted constitutes acceptance of the updated terms. We will update the "Last updated" date at the top of this page.

These Terms of Use are governed by the laws of the United States. Any disputes arising from your use of BMcks Apps shall be subject to the exclusive jurisdiction of the courts located in the United States.
